Tax filing season starts Jan. 30 for most filers

WASHINGTON (AP) — The Internal Revenue Service says late changes to federal tax laws should mean only a short delay for most taxpayers to file their 2012 returns.
The agency said Tuesday that more than 120 million taxpayers — about 80 percent of all filers — should be able to start filing their federal returns on Jan. 30. Others will have to wait until late February or March to file because the agency needs time to update and test its systems.
Those who will have to wait include people claiming residential energy credits, depreciation of property or general business credits. The filing season had been slated to start Jan. 22 but was delayed because of the big tax package passed by Congress Jan. 1.

New York governor wants casinos to spur upstate economy

(Reuters) - New York Governor Andrew Cuomo proposed on Wednesday dozens of new initiatives for the state, including new casinos and other measures aimed at helping upstate areas regain their financial footing after decades of economic decline.
Cuomo, in his annual State of the State address, proposed locating up to three casinos upstate to increase tourism and provide some local property tax relief and education funds for struggling cities.
New York legislators agreed last year to legalize public casinos, saying they would amend the state constitution to expand gambling outside Native American resorts. They must still finalize the legislation.
Cuomo also said the state, with a population of nearly 20 million, would launch new marketing plans that include duty-free stores for New York-made products and a national white-water rafting competition.
Cuomo floated several ideas for supporting fledgling businesses, including the creation of a $50 million venture capital fund. He also proposed 10 high-tech incubator "hot spots" in which start-up companies would not have to pay business, property or sales taxes.
The plans were just a few of the dozens put forward by Cuomo in what he said was the most aggressive agenda he has proposed since taking office in January 2011. But he did not indicate in his speech how any of the proposed programs would be funded.
Speaking for more than an hour, Cuomo said he would focus on upgrading the state's fuel delivery system, subways, and other infrastructure to prevent multibillion-dollar damage from severe weather events like Superstorm Sandy, which slammed into the region on October 29.
He also proposed specific new restrictions on firearms in the wake of deadly shooting rampages in late 2012 in Newtown, Connecticut, and Webster, New York.
And he said the state's minimum wage should rise to $8.75 an hour from the current $7.25.
"We have daunting challenges," he said. "But these challenges also pose exciting opportunities."
Several of New York's local governments have faced severe financial struggles after the recession, including Nassau and Suffolk counties, both on Long Island to the east of New York City.
But several cities in the northern and western parts of the state, including Syracuse, Rochester and Buffalo, have been losing jobs for many years.
On Wednesday, Moody's Investors Service downgraded Niagara Falls to Baa1 from A2, warning that it could cut the credit rating further if the city loses a legal dispute with the Seneca Nation over gambling revenue.
Cuomo proposed creating a program that would advise local governments on how to restructure their finances.
The program would be run jointly by private consultants, the state's budget division, the attorney general and New York State Comptroller Thomas DiNapoli, whose program to monitor municipal fiscal distress went into effect this year.
He also said the state should consider spending $1 billion to create or preserve 14,000 units of affordable housing over the next five years.

US tax code longer than Bible _ without good news

WASHINGTON (AP) — Too intimidated to fill out your tax return without help? Join the club.
At nearly 4 million words, the U.S. tax law is so thick and complicated that businesses and individuals spend more than 6 billion hours a year complying with filing requirements, according to a report Wednesday by an independent government watchdog.
That's the equivalent of 3 million people working full-time, year-round.
"If tax compliance were an industry, it would be one of the largest in the United States," says the report by Nina E. Olson, the National Taxpayer Advocate.
The days of most taxpayers sitting down with a pencil and a calculator to figure out their taxes are long gone, Olson said. Since 2001, Congress has made almost 5,000 changes to U.S. tax law. That's an average of more than one a day.
As a result, almost 60 percent of filers will pay someone to prepare their tax returns this spring. An additional 30 percent will use commercial software. Without the help, Olson says, most taxpayers would be lost.
"On the one hand, taxpayers who honestly seek to comply with the law often make inadvertent errors, causing them to either overpay their tax or become subject to IRS enforcement action for mistaken underpayments," Olson said. "On the other hand, sophisticated taxpayers often find loopholes that enable them to reduce or eliminate their tax liabilities."
Olson ranks complexity as the most serious tax problem facing taxpayers and the Internal Revenue Service in her annual report to Congress. She urges lawmakers to overhaul the nation's tax laws, making them simpler, clearer and easier to comply with.
Momentum is building in Congress to overhaul the tax code for the first time since 1986. But Washington's divided government has yet to show it can successfully tackle such a task.
President Barack Obama and Republican leaders in Congress say they are onboard, though they have rarely seen eye to eye on tax policy. They struggled mightily just to avoid the year-end fiscal cliff, passing a bill that makes relatively small changes in the nation's tax laws.
Undaunted, the top tax writer in the House says he is determined to pass reform legislation this year.
"This report confirms that the code is 10 times the size of the Bible with none of the good news," said Rep. Dave Camp, chairman of the House and Ways and Means Committee. "Our broken tax code has become a nightmare of loopholes and special interest provisions that create added complexities and costs for hardworking taxpayers and small businesses."
"Comprehensive tax reform will make sure everyone is playing by the same rules and help businesses create more jobs and invest in their workers," Camp said.
The general formula for tax reform is widely embraced on Capitol Hill: Eliminate or reduce some tax credits, exemptions and deductions and use the additional revenue to pay for lower income tax rates for everyone. There is, however, no consensus on which tax breaks to scale back.
That's because Americans like their credits, deductions and exemptions — the provisions that make the tax law so complicated in the first place. Would workers want to pay taxes on employer-provided health benefits or on contributions to their retirement plans? How would homeowners feel about losing the mortgage interest deduction?
Those are the three biggest tax breaks in the tax code, according to congressional estimates. Together, they are projected to save taxpayers nearly $450 billion this year.
In all, taxpayers will save about $1.1 trillion this year by taking advantage of tax breaks, according to the Joint Committee on Taxation, the official scorekeeper for Congress. That's almost as much as individuals will pay in income taxes.
To avoid angering millions of constituents who rely on popular tax breaks, politicians prefer to endorse tax reform without getting into specifics. Instead, they say they want to reform the tax code by eliminating special interest "loopholes" that help only small but well-connected groups of taxpayers.
Obama has repeatedly said he wants to eliminate tax breaks for hedge fund managers and companies that buy corporate jets. Throughout the recent fiscal cliff debate, House Speaker John Boehner said he favored raising additional tax revenue by reducing unspecified tax loopholes rather than raising income tax rates.
Olson defines "loopholes" as tax breaks that benefit someone else. She warns that targeting only narrow provisions won't raise enough revenue to significantly lower rates or make the law much simpler.
"That's what we've been trying to say to taxpayers, that the special interests are us. It's not just oil and gas or whatever you want to point your finger at," Olson said. "That's not where the money is.

Mission Impossible?: Can Tom Cruise Launch a Box-Office Franchise with 'Jack Reacher'?

 Paramount hopes it's launching a franchise with "Jack Reacher," the Tom Cruise action thriller that hits theaters Friday.
It will be tricky in a crowded holiday marketplace, and Cruise isn't the box-office bonanza he once was. But one need only look back to last year's "Mission: Impossible - Ghost Protocol" to see how it might work. That film opened to $12 million on December 16 and went on to make $209 million and nearly $700 million worldwide for Paramount.
"Jack Reacher" will be in about 3,200 theaters, and it will have plenty of competition. Universal's Judd Apatow comedy "This Is 40" opens wide Friday, and Paramount's ‘Guilt Trip" and Disney's 3D re-release of "Monsters Inc." opened Wednesday.
A slew of limited releases, led by Kathryn Bigelow's "Zero Dark Thirty," along with this year's winner of the Palme d'Or at Cannes "Amour," and tsunami survival tale "The Impossible" are also competing for moviegoers' attention, along with a number of holdover hits.
No movie, though, will come close to catching reigning box-office champ "The Hobbit: An Unexpected Journey," which remains in more than 4,000 theaters. Peter Jackson's latest Middle-earth epic will take in north of $40 million, industry analysts say, with "Jack Reacher" and "This Is 40" battling for second with less than half of that.
Warner Bros.' "Hobbit" has rolled to $106 million in the U.S. since opening to $85 million last weekend. Its international total - $188 million as of Thursday - is even bigger.
In "Jack Reacher," Cruise plays an ex-military investigator; the film is based on bestselling author Lee Child's novel "One Shot" and written for the screen and directed by Christopher McQuarrie. It's from David Ellison's Paramount-based Skydance Productions and was produced for about $60 million by Cruise, Don Granger, Paula Wagner and Gary Levinsohn.
Robert Duvall and Richard Jenkins co-star in the PG-13 crime thriller, which has a 53 percent positive rating at Movie Review Intelligence.
No is expecting "Jack Reacher" to match "MI:4" at the box office. The Reacher novels have a following, but nowhere near that of the "Mission Impossible" franchise. Cruise's recent box-office record has been uneven, and the film's Facebook and Twitter activity is not particularly strong.
"Jack Reacher" could wind up playing more like Cruise's "Knight and Day," which opened to $20 million and went on to make $76 million for Fox in 2010, or "Valkyrie," which did $83 million in 2008 after opening to $21 million. Cruise was critically lauded for his foray earlier this year as an aging rock icon in the musical "Rock of Ages," but that was one of the year's bigger box-office duds.
"Jack Reacher" should play strongly with action fans, but Cruise's personal problems could limit its broader appeal.
"I can't imagine his divorce from Katie Holmes and the custody battle hasn't hurt him some with women," BoxOffice.com vice president and chief analyst Phil Contrino told TheWrap Thursday. "Actions fans will come out, but going beyond that demographic is going to be tough for him."
On the other hand, Universal says that it tracking suggests "This Is 40" will do quite well with women -- and women over 25 in particular.
"This Is 40," is, as the marketing campaign points out, a "sort of sequel" to Apatow's "Knocked Up," which opened to $30 million and went on to make nearly $150 million five years ago. Like "This Is 40," that one was written and directed by Apatow and starred Paul Rudd and Leslie Mann.
"40" is the fourth film Apatow has directed, all for Universal ("Funny People" and "40-Year-Old Virgin" are the other two). The ensemble cast also features Albert Brooks, John Lithgow, Megan Fox, Maude Apatow, Iris Apatow, Chris O'Dowd, Jason Segel, Melissa McCarthy and Lena Dunham.
It's R-rated and has a 62 percent positive rating at Movie Review Intelligence. The production budget was $35 million.
"This looks like the strongest comedy of the season," Jeff Bock, senior analyst at Exhibitor Relations told TheWrap, "but it's still a bit of a wild card. It's going to connect with the New York and L.A. crowds; the key will be whether the Heartland audiences embrace it or see it as a little too hip. It will take time to tell, because of the season."
Films released at this time of year tend to open lower because the marketplace is so crowded - by Friday, 11 new films will have hit opened this week - and the fact that many potential moviegoers are districted by shopping and other holiday preps. On the other hand, they often show lasting power and make up what they don't take in on the weekend with stronger showings on the weekdays.
"Things could well come in lower than people are expecting across the board this weekend," Bock said, "but look for many of these movies to make it up over the holidays."
Summit will be looking for that kind of slow build on "The Impossible," the English-language film from Spain based on a true story about a family's fight to survive the 2004 tsunami in Thailand. Ewan McGregor and Naomi Watts, who received a Best Actress nomination from SAG recently, star.
Summit is releasing it Friday in 15 theaters in New York, Los Angeles, Chicago, Philadelphia, Phoenix, San Francisco, Washington, D.C., and Toronto. The plan is to go nationwide early next year.
"The Impossible" already has taken in $52 million in Spain, the home of the real-life couple upon whom the story is based as well as director Juan Antonio Bayona ("The Orphanage") and screenwriter Sergio Sanchez.
Other limited rollouts set for Friday include Paramount's 3D concert film "Cirque du Soleil: Worlds Away," in 800 theaters; "On the Road," IFC Films' adaptation of the Jack Kerouac's beat generation novel, in four theaters; and "Not Fade Away," the Paramount Vantage tale of a group of 1960 New Jersey friends launching a rock band, written and directed by "Sopranos" creator David Chase, in three locations.
Sony's "Zero Dark Thirty," about the manhunt for Osama bin Laden, got off to a terrific start Wednesday. It racked up $124,848 from five theaters in its first day of release. That's an average of $24,969, making it one of the biggest limited mid-week openings in history.

The sale of the NYSE and the death of stocks

T
o the general public, it's quite a "shocker," says David Weidner at MarketWatch. IntercontinentalExchange (ICE), an upstart derivatives exchange, based in Atlanta, is buying NYSE Euronext, the company that owns the iconic, 220-year-old New York Stock Exchange, in a deal worth more than $8 billion. To long-time market professionals, however, this merger merely confirms something they've known for quite some time. They've been witnessing the slow death of stocks — as the lord of the marketplace — for years, as new regulations and decimalization of trades once done using rounder fractions "effectively squeezed the margins — and the potential for graft — out of the system." Initial public offerings offered healthy profits, but even those have dried up recently, leaving the NYSE and other exchanges "searching the globe for a merger partner," hoping they could buy their way to growth. But the lucrative futures and options exchanges that seemed like natural buyers of the stock exchanges turned up their noses, asking, "Why would we need them?"
There was an exception. The newcomer to the derivatives party, the IntercontinentalExchange (ICE) needed something to vault it into the conversation — even though it not only had profits, but market share and a valuation to rival any exchange in the world.

For all of its lackluster financial cosmetics, the NYSE is still the Big Board. It is the venue where the great corporations of the world are listed. The announced deal will have some opportunities for technology sharing and other efficiencies, but mostly its an $8.2 billion deal for a brand.
As if that weren't already humiliating enough for the Big Board, says Felix Salmon at Reuters, "stock trading is a complete afterthought in this deal" for ICE. "The real reason that ICE wants the company is Liffe, NYSE Euronext's London-based financial derivatives subsidiary." Derivatives exchanges, you see, are few. They compete only with each other, so they make money hand over fist. "There are lots of stock exchanges," so they compete fiercely with each other, "and none of them make much money."
You can almost hear ICE CEO Jeffrey Sprecher rolling his eyes and wondering why on earth he needs to hang on to what at this point is little more than a heavily-guarded tourist attraction... [But] it's actually a good thing that stock trading has become a low-margin, low-value business: that's what's meant to happen when you have lots of competition. Think of it as one of the few areas of the financial-services sector where capitalism works as advertised. 
This deal, once unthinkable, really does underscore "what a dog the stock trading business has become," say Zachary M. Seward and Matt Phillips at Quartz. There's just no denying it. But if all this gloom is driving down the value of stocks in everybody's eyes, maybe equities markets will soon be so undervalued that they'll bounce back.
If we were contrarians, all of this Death of Equities talk — reminiscent of the 1979 Businessweek cover that nearly nailed the bottom of the markets before surges of the 1980s and 1990s — might get us a little more interested in the markets.
